O'Neal Steel, Inc. must have an authorized signature from a representative from your company. Please read the following statement and complete the four spaces below. Upon completing this form, please fax or mail it to O'Neal with your Request For Credit. Fax: 205-599-8392, Attn: Accounts Receivable. Mail: Accounts Receivable Department, O'Neal Steel, Inc., P.O. Box 2623, Birmingham, AL 35202. The undersigned hereby certifies that the above information is correct, that it is submitted for the purpose of obtaining credit, and the undersigned agrees to all of the terms and conditions of sales of O'Neal Steel, Inc., (O'Neal), including but not limited to interest at the rate of eighteen percent (18%) per annum on all past due accounts (calculated from and after the date of the purchase), plus payment of all courts costs and attorneys' fees incurred by O'Neal in the event the account is turned over to an attorney for collection. Such attorneys' fees shall be the greater of (a) the number of hours worked by O'Neal's attorneys times a reasonable hourly fee or (b) an amount equal to percentage contingent fee which O'Neal has agreed to pay the attorneys for collection of amounts due and owing in case of this kind. A copy of this contingent fee agreement is on file in the offices of O'Neal and the undersigned understands it is available to the undersigned upon request. In the event the account is turned over to attorneys, all amounts owed shall be paid through the offices of the attorneys. If legal action becomes necessary by either O'Neal or the undersigned, it is also agreed that this or any contemporaneous or subsequent agreement will be governed as to validity, interpretation, construction, effect, and in all other respects by the laws of the State of Alabama and that venue in any such action will be deemed proper and the undersigned hereby agrees to such venue in any of the following locations, which choice shall be at the option of O'Neal; the county and state of residence of the undersigned or the guarantors of the applicant for credit, Jefferson County, AL The undersigned also authorizes O'Neal to inquire of principal trade creditors, banks, other credit references to check credit and allow O'Neal to answer questions from others and further the undersigned specifically authorizes O'Neal to answer questions from others about the credit experience with the undersigned.
